Immigration Waivers
How to Successfully Obtain Waivers (Forgiveness) from USCIS, U.S. Consulates, or Immigration Judges
Waivers are a very complex, yet important, part of immigration law. Also known as “requests for forgiveness,” waivers give immigrants, at any stage in the citizenship process, a legal way to ask the U.S. government to forgive past problems such as:
- Previously committed fraud or misrepresentation
- Criminal history
- Previously denied waivers due to poor preparation and documentation by prior counsel
Our Immigration Lawyers Know How to Win
Our experienced legal team at Nalbandian Law is headed by veteran immigration attorney Sassoun A. Nalbandian. We are proud of our near-perfect record* of winning waiver applications for clients who come to us with the most serious problems.
Waivers are very difficult to obtain due to USCIS’ high standards and burdens of proof. That’s why we prepare meticulously detailed, well documented waivers that meet and surpass the highest expectations of immigration judges, USCIS, and/or U.S. consular officers.
Types of Immigration Waivers
Our attorneys have routinely handled many types of waivers including:
- 212(i) waivers and 209(c) waivers on forms I-601 and I-602
- 237(a)(1)(H) waivers for cases such as a green card that was obtained through:
- Fraud or misrepresentation committed when you entered the U.S.
- Fraud or misrepresentation on immigration paperwork you previously filed with USCIS or any other government agency to receive an immigration benefit
Nalbandian Law is proud of the fact that we have won nearly all of our waiver applications*, including the toughest ones. For example, some clients have come to us with waiver packets that were previously denied because their ex-lawyer failed to prepare and document them properly.
In those instances, we resubmitted our own carefully prepared waiver packet. Even though the USCIS or the U.S. consulate had originally denied the poorly prepared waiver request from the previous attorney, our waiver request was granted after further review!
You may think immigration laws have closed the door to your green card or citizenship, but Nalbandian Law has the experience and determination to open that door again.
